These terms govern your use of CaratBid as a seller or as a verified diamond buyer.

Template notice: this document is a drafting starting point prepared for CaratBid and must be reviewed and finalised by a qualified lawyer before launch. Company registration details, the data controller entity and supervisory authority still need to be inserted.

1. Our role

CaratBid is an introduction marketplace. We do not buy, sell, value, appraise, insure, transport or take possession of diamonds, and we are not a party to any transaction between a seller and a buyer. We provide no valuation, financial or investment advice.

2. Eligibility and accounts

You must be at least 18 years old. Information you provide must be accurate, and you are responsible for activity on your account. We may suspend or close accounts that breach these terms.

3. Seller obligations

  • You must be the lawful owner of the diamond, or authorised to sell it.
  • Descriptions, certificates and photographs must be accurate and relate to the diamond submitted.
  • You may not submit stolen, encumbered or unlawfully obtained goods.

4. Buyer obligations

  • Buyers must complete verification and keep their business information current.
  • Offers must be made in good faith and reflect a genuine intention to purchase.
  • Buyers must not approach sellers outside CaratBid to circumvent the marketplace.
  • Information about a seller's diamond must be treated as confidential.

5. Offers and acceptance

Offers are indications of what a buyer is prepared to pay based on the information provided and may be subject to physical inspection and verification. A seller is under no obligation to accept any offer. Accepting an offer through CaratBid is an agreement to proceed with that buyer in good faith; the sale contract is formed directly between the seller and the buyer.

6. Fees

Submitting a diamond and receiving offers is free for sellers. Buyer participation may be subject to fees set out in a separate buyer agreement.

7. Prohibited conduct

You may not misuse the platform, scrape data, attempt unauthorised access, misrepresent goods, or use CaratBid for money laundering or any unlawful purpose.

8. Liability

To the fullest extent permitted by law, CaratBid is not liable for the conduct of sellers or buyers, the accuracy of listings, the outcome of any inspection, payment or shipment, or for any indirect or consequential loss. Nothing limits liability that cannot be limited by law.

9. Changes and governing law

We may update these terms and will publish the revised version here. The governing law and competent courts will be those of the jurisdiction of the CaratBid legal entity, to be confirmed on registration.
